When it comes to divorce, I really have no idea where to begin. How does it work? How does it work when a child is involved? The thought of it really still makes me sick to my stomach and so sad, but I need to be prepared.
Tomorrow I meet with a divorce attorney. I scheduled this appointment so I could find out any details. I don’t want to be surprised by anything.
So, I’ll outline the questions I’m going to ask, and I’ll make another post with what I learn.
Side note, I live in North Carolina, and there are different laws in each state so make sure to look into this if you are going through a divorce.
Some questions I’m going to ask the divorce attorney:
- What is the difference between physical and legal custody?
- What are the child custody laws in NC?
- Are we able to decide between the two of us that we want joint legal and physical custody?
- Do we have to have it all laid out who gets my daughter when or can this fluctuate?
- How do you begin a divorce? What has to get done to file?
- Does a court have to be involved?
- Do we need lawyers?
That’s all I have. Maybe that shows how much I don’t know about divorce.
My daughter’s dad travels at least 70% of the year for work. Does that come into play with anything? Are we able to make every decision as long as we agree on everything?
So many questions. Divorce is heavy. Not only what comes with it with your own life changing, but when you have children involved, divorce means losing time with them too.
My only, unexperienced advice is to protect yourself, get an attorney to make sure you know what to expect and always put your children first. If you do that, I don’t think you can go wrong.

Post update: I’d recommend doing your research on an attorney to use. They can make or break your case and I’ve heard some horror stories of unsupportive attorneys that don’t have your back. If you are in the Asheville, NC area and need an Attorney, I’ve got nothing but good things to say about Tuorto Family Law.
